ZOREAL Mark Terms

This document is issued by Bynn Intelligence, Inc. and supplements the general Terms of Service, which continues to apply; where the two differ in respect of the ZOREAL Mark browser extension and record service, this document prevails. The matching Privacy Notice for the same product is published alongside it.

1. Agreement

These Terms govern your use of the ZOREAL Mark browser extension (the "Extension") and of the ZOREAL Mark record service at mark.zoreal.com and api.zoreal.com (the "Service"), provided by Bynn Intelligence Inc. ("Bynn", "we", "us"). They supplement the general ZOREAL Terms of Service, which continue to apply, including their provisions on governing law, dispute resolution and contact. Where the two differ in respect of the Extension or the Service, these Terms prevail. By installing or using the Extension, or by requesting or reading a record from the Service, you agree to these Terms. If you do not agree, do not install or use them.

2. The software licence

The Extension and the verification library it embeds are licensed to you under the MIT License, the text of which is included with the software. Nothing in these Terms limits the rights that licence grants you in the software. These Terms apply to the Service and to the records it publishes, which are not software and are not licensed under the MIT License.

3. What a Mark is, and is not

A ZOREAL Mark is a statement, recorded by the Service, that a real person verified by ZOREAL vouched for a specific text, on a specific page, at a specific time, and a cryptographic record that allows anyone to check that statement. A Mark does not assert that the person wrote the text, that the text is true, or anything about the account that posted it. The Extension displays what the record proves and nothing more, and you agree not to represent a Mark as proving anything else.

4. Verification is provided as is

Verification is performed in your browser by open-source software against published root certificates, and depends on the availability of the Service and on the page presenting the Mark unchanged. A verdict of "cannot verify now" means the record could not be fetched; it is not a finding against the Mark. To the fullest extent permitted by law, the Extension and the Service are provided "as is" and "as available", without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.

5. Signing

Signing requires a ZOREAL ID and is subject to the ZOREAL ID terms. When you sign, you instruct us to publish a public, permanent record as described in the ZOREAL Mark Privacy Notice. You confirm that you are the holder of the ZOREAL ID used, that you have read the text you are signing, and that you understand that a record can be withdrawn but not deleted. Signing under your legal name publishes that name; do so only when you intend it.

6. Acceptable use

You agree not to: use the Extension or the Service to impersonate any person or organisation; sign, or cause to be signed, any text on behalf of a person who has not personally approved it on their own ZOREAL ID; interfere with, overload, probe or circumvent the Service or its rate limits; attempt to alter, forge or replay a record, a signing request or a verification; or use the Service in violation of applicable law or of the rights of others. We may suspend or refuse service to any party that breaches this Section.

7. Public records

Records published by the Service are public and may be read, copied, cached and verified by anyone. We make no commitment to remove a record and will not do so except as required by law, since removal would undermine the purpose of every other record. A signer may withdraw their own record through the ZOREAL ID application; the withdrawal is appended to the record and is visible to everyone who verifies it.

8. Changes and termination

We may update the Extension, the Service and these Terms. Updates to the Extension are delivered through your browser's extension store. Material changes to these Terms will be announced on this page before they take effect; your continued use after that date is acceptance. We may discontinue the Service on reasonable notice; published records will be preserved in the signed archives described in the ZOREAL Mark documentation for as long as we operate them.

9. Liability

To the fullest extent permitted by law, Bynn shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or reputation, arising out of or in connection with the Extension, the Service or any record, whether in contract, tort or otherwise. Where liability cannot be excluded, it is limited to the amount you paid for the Service in the twelve months before the claim, which for a free service is nil, or to the minimum amount the applicable law permits.
